Terms of Service
Last updated: 6/3/2026
1. Acceptance of Terms
By accessing and using Acurrate ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Acurrate is an influencer marketing platform that helps brands and marketers (a) discover and evaluate content creators across public social-media platforms, and (b) calculate accurate rates and ROI for influencer collaborations based on conversion data, profit margins, and target metrics.
Creator Discovery: The Service includes a searchable database of publicly available information about content creators on third-party platforms (including Instagram, TikTok, and YouTube), together with automated estimates of audience demographics, niche, authenticity, and expected performance. The collection, lawful basis, and sources of this information are described in our Privacy Policy.
Shopify App Store: Acurrate is primarily distributed through the Shopify App Store. When you install Acurrate from the Shopify App Store, the app integrates with your Shopify store to automatically access historical order data, product information, and analytics to provide accurate ROI calculations. The app has read-only access to your store data and does not modify any information in your Shopify store.
Team Management: Store owners can invite team members (Editors and Viewers) to collaborate on influencer calculations and campaign planning. Team members share access to the same store data and calculations, with role-based permissions controlling what actions they can perform.
3. User Accounts
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable local, state, national, or international law
- Transmit any harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use automated means to access the Service without permission
- Reverse engineer, decompile, or disassemble the Service
- Scrape, copy, bulk-export, or systematically extract the creator discovery database or any substantial part of it, whether by manual or automated means, including by querying our APIs at volumes beyond normal interactive use
- Re-sell, re-distribute, syndicate, or make the creator discovery data available to third parties as a standalone dataset or service
- Use the Service, or any data obtained through it, to build or train any competing product, dataset, machine-learning model, or index
Outreach and communications to creators: Acurrate may display publicly listed business contact details (for example, business email addresses shown on a creator's public profile or website). If you use any such contact details to contact a creator, you are the sender of that communication and you are solely responsible for compliance with all applicable laws, including:
- The UK GDPR, UK Data Protection Act 2018, and EU GDPR (including lawful basis, transparency, and objection rights)
- The UK Privacy and Electronic Communications Regulations (PECR) and equivalent rules in the EU and other jurisdictions
- The US CAN-SPAM Act and Canadian Anti-Spam Legislation (CASL), where applicable
- The terms of service of any third-party platform you use to make contact
You agree to contact creators only for legitimate business-to-business commercial collaboration purposes, to honour opt-out and unsubscribe requests promptly, and not to use the Service to send bulk unsolicited marketing, spam, fraudulent, harassing, or misleading communications. You are responsible for maintaining your own suppression lists.
Third-party platform compliance: You agree to comply with the terms of service of Instagram, TikTok, YouTube, and any other third-party platform from which discovery data originates. You will not use the Service to circumvent any platform's rate limits, access controls, or content policies.
5. Shopify Integration and Data Access
Shopify App Store: Acurrate is available as a Shopify app. When you install Acurrate from the Shopify App Store, you grant us permission to access certain data from your Shopify store for the purpose of providing ROI calculation services.
Data Access Permissions: By installing Acurrate, you authorize us to:
- Access order data (including orders older than 60 days) to calculate historical metrics
- Access product information for industry detection
- Access store analytics data
- Access customer records under Shopify Protected Customer Data Levels 1 + 2, including customer IDs, order numbers, customer names, and customer email addresses, approved by Shopify on 2026-04-22 (reference 103226), for the purposes described in the Privacy Policy (returning-customer-rate analysis, lifetime-value forecasting, creator-to-customer matching, and campaign attribution)
Read-Only Access: Acurrate has read-only access to your Shopify store data. We do not modify, create, or delete any data in your Shopify store. We do not have write permissions for products, orders, customers, or any other store data.
Protected Customer Data (PCD): Raw customer PCD is retained for a maximum of 30 days after last sync and is then automatically deleted. Aggregated, non-identifying metrics derived from PCD (such as per-customer lifetime value figures, returning customer rate, or match counts) may be retained indefinitely. PCD is stored in the EU region, is never transmitted to third parties or external AI / analytics providers, and every access is logged to an append-only audit trail per Shopify's Partner Program requirements. If you uninstall Acurrate, all PCD tied to your store is deleted within 48 hours. You may request earlier deletion at any time. See Section 6 of our Privacy Policy for full detail.
Your responsibilities as the data controller: Under UK GDPR, EU GDPR, and comparable privacy laws, you remain the data controller for your customers' personal information. By installing Acurrate, you confirm that you have a lawful basis to share this data with us as a processor (typically legitimate interest or contract-performance). You are responsible for informing your customers of this processing in your own privacy notice, and for handling customer rights requests directed at you. We will assist with such requests promptly upon notice.
Uninstallation: You may uninstall Acurrate from your Shopify store at any time through your Shopify admin panel. Upon uninstallation, we will no longer have access to your store data. Historical calculation data stored in Acurrate will be retained according to our data retention policies.
Billing: For Shopify App Store installations, billing is managed through Shopify's billing system. Subscription charges and seat purchases will appear on your Shopify billing statement.
6. Data and Calculations
While we strive to provide accurate calculations and insights:
- All calculations are estimates based on the data you provide
- Results may vary based on actual campaign performance
- We do not guarantee specific outcomes or ROI results
- You are responsible for verifying and validating all calculations
- We are not liable for business decisions made based on our calculations
Creator Discovery Data: Information in the creator discovery database — including follower counts, engagement metrics, audience demographics, authenticity scores, niche classifications, brand affinity, and predicted performance — is collected from public sources and/or generated by automated inference (including AI models). It is provided on an "as is" basis for evaluation purposes only. It may be inaccurate, incomplete, out of date, or superseded by platform changes. You must not rely on it as the sole basis for commercial, contractual, or editorial decisions, and you are responsible for independently verifying any information before acting on it. Appearance of a creator in the database is not an endorsement by that creator of Acurrate or of any customer, and does not imply any existing commercial relationship.
Demo Content & Marketing Materials: Screenshots, examples, and demonstrations shown on our website, marketing materials, and product demos may display publicly available creator profiles and social media content. Fees, ROI projections, and campaign outcomes shown in these materials are fictional examples created solely for demonstration purposes and do not reflect actual performance data, endorsements, or real campaign results. We make no claims about the actual performance or suitability of any creator shown in our marketing materials.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Acurrate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Proprietary Algorithms: Acurrate's calculation methodologies, algorithms, formulas, scoring systems (including but not limited to AcuScore™), prediction models, and data processing techniques are proprietary trade secrets. You expressly agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms
- Extract, scrape, or systematically collect calculation formulas or methodologies
- Use automated tools to perform bulk calculations for the purpose of reverse engineering
- Copy, reproduce, or replicate our proprietary calculation methods in any competing product or service
- Share, sell, or distribute any proprietary methodologies discovered through use of the Service
You retain ownership of any data you input into the Service. By using the Service, you grant us a limited license to use your data to provide the Service to you.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.
9. Payments and Refunds
Billing Methods: Acurrate offers two billing methods depending on how you access the service:
- Shopify App Store: If you install Acurrate from the Shopify App Store, billing is processed through Shopify's billing system. Subscriptions and additional seat purchases are managed through your Shopify account and appear on your Shopify billing statement.
- Direct Website: If you sign up directly through our website (organic users), billing is processed through Stripe. Payment is due at the beginning of each billing period.
Subscriptions: Pro subscriptions are billed on a recurring basis (monthly or annually) depending on your selected plan. Additional team seats can be purchased and are billed according to your subscription plan.
Refunds: All sales are final. We do not offer refunds or pro-rated refunds for subscription fees. You may cancel your subscription at any time, but no refunds will be issued for the current billing period. In exceptional cases involving technical failures or billing errors, refunds may be issued at our sole discretion.
Cancellation: You can cancel your subscription at any time through your account settings (for direct users) or through your Shopify app settings (for Shopify App Store users). Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refund will be provided for unused time.
Price Changes: We reserve the right to change our pricing at any time. Launch pricing is locked in for life for early adopters who maintain an active subscription. If you cancel and rejoin later, you will be charged at the current standard pricing.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.
You may also terminate your account at any time by contacting us or using account deletion features in the Service.
11. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Service, including:
- Accuracy, reliability, or completeness of calculations
- Uninterrupted or error-free operation
- Security of data transmission or storage
- Fitness for a particular purpose
12. Limitation of Liability
In no event shall Acurrate be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Acurrate, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your use of any data obtained through the Service, including any communications you send to creators and any claims brought by creators, platforms, or regulators in connection with those communications; and (d) your violation of any applicable law or the rights of any third party, including privacy, publicity, intellectual-property, and anti-spam laws.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
